WISCONSIN ABC PREVAILS IN KEYES CASE ARGUMENT

On June 14, 2007, the Court of Appeals issued a decision that implied that subcontractors could not be paid any of their profit on a job until the end of the job, and then only when it was clear that there would be enough money to fully pay all subcontractors. Wisconsin ABC believed the Court of Appeals’ decision was unworkable and wasn’t what the Legislature intended when it passed the statute. So, Wisconsin ABC joined with other associations to argue to the Wisconsin Supreme Court that the Court of Appeals was wrong in its interpretation of the statute, Section 779.02(5), Wis. Stats.

UW Stout Wins Essay Contest at ABC National Convention

Associated Builders and Contractors’ (ABC) educational affiliate, the Trimmer Education Foundation, March 8 named four teams from colleges and universities nationwide as 2008 Student Essay Competition Winners. The award-winning teams were recognized at a ceremony held during the 2008 ABC National Convention in San Juan, Puerto Rico.

NLRB Affirms Decision Protecting Right of Employers to Sue Unions

In a landmark ruling for merit shop contractors and employers nationwide, the National Labor Relations Board (NLRB) Sept. 29 upheld a U.S. Supreme Court decision protecting the First Amendment right of employers to seek protection from union abuses in the courts (BE&K Construction Co., NLRB No. 32-CA-09474). In its decision, NLRB stated that the “filing and maintenance of a reasonably based lawsuit does not violate the [National Labor Relations Act (NLRA)], regardless of the motive for bringing it.” Section 8(a)(1) of the NLRA bars employers from directing any interference, restraint or coercion against unions or union-organizing activities.


ABC, Industry Groups Move to Appeal ANSI Ergonomic Standard

ABC has joined with five other construction trade organizations, including the National Association of Home Builders, Associated General Contractors and the American Subcontractors Association, to appeal the American National Standards Institute’s (ANSI) July 23 approval of a controversial new ergonomic standard.
